1. Introduction

Welcome to Kindi (kindi.club), a school management platform designed for South African daycare centres, crèches, and early childhood development (ECD) programmes. Kindi is operated by GettinDrikkieWithIt (Pty) Ltd, a company registered in the Republic of South Africa.

By accessing or using our Service, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use Kindi. These terms apply to all users of the platform, including school administrators, teachers, and parents/guardians.

2. Definitions

  • "Service" means the Kindi web application, mobile application, and all related services provided at kindi.club.
  • "User" means any person who accesses or uses the Service, including school administrators, teachers, and parents/guardians.
  • "School" means the daycare centre, crèche, or ECD programme that subscribes to Kindi.
  • "Child Data" means any personal information relating to a child enrolled at a School, including but not limited to name, date of birth, medical information, attendance records, and developmental observations.
  • "Operator" has the meaning ascribed to it in the Protection of Personal Information Act 4 of 2013 (POPIA) and, in the context of this Service, refers to GettinDrikkieWithIt (Pty) Ltd.
  • "Responsible Party" has the meaning ascribed to it in POPIA and, in the context of this Service, refers to the School that determines the purpose and means of processing Child Data.

3. Account Registration

To use Kindi, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

  • Each School account is associated with a single daycare centre or ECD programme.
  • You must provide truthful, current, and complete registration information.
  • You are solely responsible for safeguarding your password. Kindi will never ask for your password via email or phone.
  • You must notify us immediately of any unauthorised use of your account.

4. Subscription & Billing

Kindi offers a free tier with limited features and paid subscription plans with additional functionality. Details of available plans and pricing are displayed within the application.

  • New paid subscriptions include a 14-day free trial period. You will not be charged until the trial expires.
  • Subscription billing is processed through Paystack (South Africa) or Paddle (international), depending on your location. By subscribing, you also agree to the applicable payment provider's terms.
  • Subscriptions renew automatically on a monthly basis unless cancelled before the next billing date.
  • You may cancel your subscription at any time from within the application. Cancellation takes effect at the end of the current billing period.
  • Refunds are available in accordance with our Refund Policy.
  • Kindi reserves the right to change subscription pricing with 30 days' written notice to affected Schools.

5. Data Processing

Under the Protection of Personal Information Act 4 of 2013 (POPIA):

  • The School is the Responsible Party that determines the purpose of and means for processing the personal information of children, parents, and staff.
  • GettinDrikkieWithIt (Pty) Ltd acts as the Operator, processing personal information on behalf of the School in accordance with these Terms and our Privacy Policy.
  • Kindi processes personal information only as necessary to provide the Service and in accordance with the School's instructions.
  • Kindi implements appropriate technical and organisational measures to secure personal information against loss, damage, or unauthorised access.

6. Acceptable Use

You agree to use Kindi only for lawful purposes and in accordance with these Terms. Specifically, you shall not:

  • Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Share your login credentials with any other person or allow multiple individuals to use a single account.
  • Attempt to gain unauthorised access to any part of the Service, other users' accounts, or any systems or networks connected to the Service.
  • Use automated scripts, bots, or scrapers to access or collect data from the Service without prior written consent from Kindi.
  • Use the Service to store or transmit any malicious code, viruses, or harmful technology.
  • Interfere with or disrupt the integrity or performance of the Service.

7. Intellectual Property

The Kindi platform, including its design, code, logos, trademarks, and all related intellectual property, is owned by GettinDrikkieWithIt (Pty) Ltd and is protected by South African and international intellectual property laws.

  • Your use of the Service does not grant you any ownership rights to the platform or its intellectual property.
  • All data, content, and records created by a School or its users within Kindi remain the property of the School. Kindi claims no ownership over your data.
  • You grant Kindi a limited licence to use your data solely for the purpose of providing and improving the Service.

8. Termination

Either party may terminate the use of the Service at any time:

  • By you: You may cancel your account at any time by contacting us at kindiapp.club@gmail.com.
  • By Kindi: We may suspend or terminate your access if you breach these Terms, fail to pay subscription fees, or engage in conduct that is harmful to other users or the Service.
  • Upon termination, you may request an export of your data. Kindi will make your data available for export for a period of 30 days following termination.
  • After the 30-day period, Kindi will permanently delete your data from its systems, except where retention is required by law.

9. Limitation of Liability

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by South African law:

  • Kindi makes no warranties, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • Kindi shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
  • Kindi's total liability to you for any claim arising from these Terms or the Service shall not exceed the total fees paid by you to Kindi in the twelve (12) months preceding the claim.
  • Kindi takes reasonable measures to ensure the availability and security of the Service but does not guarantee uninterrupted or error-free operation.

10. Changes to Terms

Kindi reserves the right to update or modify these Terms at any time. When we make changes:

  • We will provide at least 30 days' notice before the changes take effect, either via email or through a prominent notice within the application.
  • The updated effective date will be displayed at the top of this page.
  • Your continued use of the Service after the effective date of changes constitutes your acceptance of the revised Terms.
  • If you do not agree with the updated Terms, you must stop using the Service and close your account.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Magistrate's Court of the Republic of South Africa, unless the matter falls within the exclusive jurisdiction of a higher court.
